Gay marriage opponents ask court to intervene

(AP) ? A wave of weddings were performed in San Francisco City Hall on the heels of the U.S. Supreme Court's historic decisions to restore same-sex marriages to California, as defeated backers of the state's gay marriage ban filed a last-ditch effort to halt the ceremonies.

Less than 24 hours after California started issuing marriage licenses to same gender couples, lawyers for the Arizona-based Alliance Defending Freedom filed an emergency petition to the high court Saturday asking it to halt the weddings on the grounds that its decision was not yet legally final. They claimed the 9th U.S. Circuit Court of Appeals acted prematurely and unfairly on Friday when it allowed gay marriage to resume by lifting a hold that had been placed on same sex unions.

The motion was filed as dozens of couples in jeans, shorts, white dresses and the occasional military uniform filled City Hall to obtain marriage licenses. On Friday, 81 same sex couples received marriage licenses.

Although a few clerk's offices around the state stayed open late on Friday, San Francisco, which is holding its annual gay pride celebration this weekend, was the only jurisdiction to hold weekend hours so that same sex couples could take advantage of their newly restored right, Clerk Karen Hong said.

A sign posted on the door of the office where a long line of couples waited to fill out applications listed the price for a license, a ceremony or both above the words "Equality=Priceless."

"We really wanted to make this happen," Hong said, adding that her whole staff and a group of volunteers came into work without having to be asked. "It's spontaneous, which is great in its own way."

The timing couldn't have been better for California National Guard Capt. Michael Potoczniak, 38, and his partner of 10 years, Todd Saunders, 47, of El Cerrito.

Potoczniak, who joined the Guard after the military's ban on openly gay service was repealed almost two years ago, was scheduled to fly out Sunday night for a month of basic training in Texas.

"I woke up this morning, shook him awake and said, 'Let's go,'" said Potoczniak, who chose to get married in his Army uniform. "It's something that people need to see because everyone is so used to uniforms at military weddings."

Also waiting to wed Saturday were Scott Kehoe, 34, and his fiance, Aurelien Bricker, 24. After finding out on Facebook that the city was issuing same sex marriage licenses Friday, the San Francisco couple rushed out to Tiffany's to buy wedding rings.

"We were afraid of further legal challenges in the state," Kehoe said.

The Supreme Court ruled on Wednesday that Proposition 8's backers lacked standing to defend the 2008 law because California's governor and attorney general have declined to defend the ban.

Then on Friday, the 9th Circuit appeared to have removed the last obstacle to making same sex matrimony legal again in California when it removed its hold on a lower court's 2010 order directing state officials to stop enforcing the ban.

Within hours, same sex couples were seeking marriage licenses. The two couples who sued to overturn Proposition 8 were wed in San Francisco and Los Angeles Friday.

Alliance Defending Freedom Senior Counsel Austin Nimocks said on Saturday that the high court's consideration of the case isn't done because his clients still have 22 days to ask the justices to reconsider Wednesday's 5-4 decision.

Under Supreme Court rules, the losing side in a legal dispute has 25 days to request a rehearing. While such requests are almost never granted, the high court said that it wouldn't finalize its judgment in the case at least until after that waiting period elapsed.

The San Francisco-based appeals court had said when it imposed the stay that it would remain in place until the Supreme Court issued its final disposition, according to Nimocks.

"Everyone on all sides of the marriage debate should agree that the legal process must be followed," he said. "On Friday, the 9th Circuit acted contrary to its own order without explanation."

Many legal experts who had anticipated such a last-ditch effort by gay marriage opponents said it was unlikely to succeed because the 9th Circuit has independent authority over its own orders ? in this case, its 2010 stay.

While the ban's backers can still ask the Supreme Court for a rehearing, the 25-day waiting period is not binding on lower federal courts, Vikram Amar, a constitutional law professor with the University of California, Davis law school, said.

"As a matter of practice, most lower federal courts wait to act," Amar said. "But there is nothing that limits them from acting sooner. It was within the 9th Circuit's power to do what it did."

The city, home to both a federal trial court that struck down Proposition 8 as unconstitutional and the 9th Circuit, has been the epicenter of the state's gay marriage movement since then-Mayor Gavin Newsom ordered his administration in February 2004 to issue licenses to gay couples in defiance of state law.

A little more than four years later, the California Supreme Court, which is also based in San Francisco, struck down the state's one-man, one-woman marriage laws.

City Hall was the scene of many more marriages in the 4 1/2 months before a coalition of religious conservative groups successfully campaigned for the November 2008 passage of Proposition 8, which amended the state constitution to outlaw same sex marriages.

"It's a dull Friday," said Gary Flam, a?stock?manager at Bel Air Investment Advisors. A bull market, he added, is "rarely a straight march up."

The Standard & Poor's 500 index ended its bumpy ride in June down 1.5 percent, the first monthly loss since October. The index still had its best first half of a year since 1998.

Investors seemed unsure how to react to recent statements by Federal Reserve officials about when the central bank might end its support for the economy. Mixed economic news Friday added to investor uncertainty after bigstock?gains.?

On Friday, an index consumer confidence was up but a gauge of business activity in the Chicago area plunged.

"Investors don't know what to make of the news," said John Toohey, vice president of?stock?investments at USAA Investment Management. "I wouldn't be surprised to see more ups and downs."

The S&P 500?stock?index closed down 6.92 points, or 0.4 percent, to 1,606.28. The Dow Jones industrial average fell 114.89 points, or 0.8 percent, to 14,909.60. The Nasdaq composite index rose 1.38 points, or 0.04 percent, to 3,403.25.

Stocks?have jumped around in June. By contrast, the first five months of the year were mostly calm, marked by small but steady gains as investors bought on news of higher home prices, record corporate earnings and an improving jobs market.

By May 21, the S&P 500 had climbed to a record 1,669, up 18 percent for the year. Fed Chairman Ben Bernanke spoke the next day, and prices began gyrating.

Investors have long known that the central bank would eventually pull back from its bond purchases, which are designed to lower interest rates and get people to borrow and spend more. Last week, Bernanke got more specific about the timing. He said the Fed could start purchasing fewer bonds later this year, and stop buying them completely by the middle of next year, if the economy continued to strengthen.

Investors dumped?stocks, but then had second thoughts this week as other Fed officials stressed that the central bank wouldn't pull back on its support soon. The Dow gained 365 points over the previous three days this week. The Dow has had 16 triple-digit moves for the month, the most since September 2011.

Bonds have also been on a bumpy ride in recent weeks, mostly down.

Android 101: Keep your apps up to date

Those apps aren't going to update themselves ... by default, that is

One of the best parts about owning a smart phone is the limitless possibilities of installing apps that can do so much more than the phone can out of the box. The unfortunate downside is trying to keep up with the seemingly constant flow of app updates coming to your device every day. But you're in luck, as Android has had automatic updating of apps through the Play Store since back in the day when it was still the Android Market, and it's a simple process to get set up.

Head to the Google Play Store on your device, hit the menu button and go to "settings". If it isn't already set by default, go ahead and tap the "Auto-update apps" setting and choose the most appropriate setting for your needs -- no updates, updates only on Wifi, or all updates. Most people with limited data buckets will be best-off with the "Auto-update apps over Wifi only" option. Once you have turned on automatic updates of either kind, you can always turn off automatic updates for a particular app by navigating to its Play Store listing (from the "My apps" area) and tapping the menu button, then un-checking the "Auto-update" box.

Rivers receding in Calgary, 3 dead in floods

CALGARY, Alberta (AP) ? Water levels dropped, providing a measure of relief to the western Canadian city of Calgary, hit hard by floods that devastated much of southern Alberta province, causing at least three deaths and forcing thousands to evacuate.

The flooding forced authorities to evacuate Calgary's entire downtown and hit some of the city's iconic structures hard. The Saddledome, home to the National Hockey League's Calgary Flames, was flooded up to the 10th row, leaving the dressing rooms submerged.

Flames' president and CEO Ken King said Saturday that the Saddledome is a "real mess," with water still up to row 8 of the lower bowl. He said the flooding had caused a total loss on the event level with all mechanical equipment submerged under 15 feet (4.5 meters) of water.

"If you were a hockey player walking out of the tunnel to the ice, you'd be underwater yourself," he said during a news conference.

Water lapped at the roof of the chuckwagon barns at the grounds of the Calgary Stampede, which is scheduled to start in two weeks. Calgary Mayor Naheed Nenshi has said the city will do everything it can to make sure that the world-renowned party goes ahead.

Bruce Burrell, director of the city's emergency management agency, said Saturday they are seeing improvements in the rivers. Dan Limacher, director of water services for the city, said the Elbow river is expected to recede by about 60 percent over the next two days, while the larger Bow river will recede by about 25 percent.

The improving conditions Saturday morning prompted Calgary's mayor to tweet: "It's morning in Calgary! Sunny, water levels are down, and our spirit remains strong. We're not out of this, but maybe have turned corner."

However, Nenshi said later Saturday that while the city may have turned a corner, there is still a state of emergency in effect.

"Flows on Elbow and Bow (rivers) are dropping slowly. We do believe the peak has passed on the Elbow. However, water levels are still four times higher than 2005 flood levels," he said during a press conference.

Overflowing rivers on Thursday and Friday washed out roads and bridges, soaked homes and turned streets into dirt-brown waterways around southern Alberta.

High River, southwest of Calgary, was one of the hardest-hit areas and remained under a mandatory evacuation order. Police said they have recovered three bodies in the town.

It is estimated that half the people in the town of 13,000 experienced flooding in their homes. Police cut off access to most of the town and helicopters circled overhead. Abandoned cars lay submerged in water, while backhoes worked in vain to push water back from houses.

Police asked residents who were forced to leave the High River area to register at an evacuation shelter. By Saturday morning, 485 evacuees had registered at the shelter in Nanton, south of Calgary, and 278 people were on the inquiry list.

The Royal Canadian Mounted Police said Saturday that during rescue and evacuation efforts on Friday in the High River area, approximately 800 people were evacuated by helicopter along with 100-200 people rescued by various water craft.

Ed Mailhot, a volunteer in High River, was working to build a database of registered evacuees and those who are looking for them. Cellphone service was not restored until late Friday.

"There are a lot of loved ones out there that people can't find, or they don't know where they are," he said. "It's still chaos."

Alberta Premier Alison Redford has warned that communities downstream of Calgary have not yet felt the full force of the floodwaters. Medicine Hat, downstream from Calgary, was under a mandatory evacuation order affecting 10,000 residents.

As the sun rose in Calgary on Saturday morning it wasn't raining. Burrell said some of the 75,000 flood evacuees from more than 24 neighborhoods will be allowed back into their homes. He said the goal is to allow people from portions of six communities back into their homes on Saturday. Residents of a neighborhood in one of those communities ? the high ground portion of Discovery Ridge ?have already been allowed back.

About 1,500 people in Calgary went to emergency shelters during the flooding, while the rest of those evacuated found shelter with family or friends, Nenshi said. Schools and courts were closed Friday. Transit service in the city's core was shut down.

Dale McMaster, executive vice president of ENMAX, Calgary's power company, said Saturday that at least 30,000 customers remain without power.

Calgary's mayor said the downtown area remained off limits and employers will have to make arrangements to have staff work remotely until at least the middle of the week.

"It is extremely unlikely that people will be able to return to those buildings before the middle of next week," Nenshi said.

Prime Minister Stephen Harper, a Calgary resident, said he never imagined there would be a flood of this magnitude in this part of Canada.

The Conservative Party said Saturday that it has postponed its federal policy convention which was scheduled to begin Thursday at the Telus Convention Centre in downtown Calgary because of the floods.

"There are neighborhoods under water, so there is a lot of work we have to do to rebuild," said Michelle Rempel, a member of Parliament for Calgary Center. "Postponing the convention is the right thing to do for the people of Calgary."

Calgary, a city of more than a million people that hosted the 1988 Winter Olympics, is the center of Canada's oil industry.

About 350,000 people work in downtown Calgary on a typical day. However, officials said very few people had to be moved out, since many heeded warnings and did not go to work Friday.

A spokesman for Canada's defense minister said 1,300 soldiers from a base in Edmonton were being deployed to the flood zone.

The Mounties added that approximately 200 additional Royal Canadian Mounted Police personnel were deployed Saturday from other parts of Alberta to assist with evacuation, rescue, traffic safety and security operations,

Calgary was not alone in its weather-related woes.

Efforts were under way Saturday to move more than 2,000 people from their homes in a flood-prone part of northeastern Saskatchewan because of rising water levels.

City centers around Brazil were still smoldering on Friday after 1 million protesters took to the streets amid growing calls on social media for a general strike next week.

While most protesters were peaceful, some small groups clashed violently with police, who responded in some cases with tear gas, pepper spray and rubber bullets.

The demonstrations began as an outcry against a 10-cent hike in bus and subway fares in Brazil's largest cities, but have continued even after announcements that the increases would be rescinded. Protesters have expressed frustration with corruption and what they say are high taxes and poor public services. They've demanded everything from education reforms to free bus fares while denouncing the billions of public dollars spent on stadiums before the World Cup and the Olympics.

Brazil will host the 2014 World Cup, but protesters say that the billions now spent on soccer stadiums would be better used for education, health and public safety.

President Dilma Rousseff has faced sharp criticism in Brazil's media for what many have called her lack of leadership, and called a Friday meeting with her Cabinet morning to discuss the matter.

High-scoring Game 4 flips script on Stanley Cup

CHICAGO (AP) ? Finding room to roam in the first three games of the Stanley Cup finals was next to impossible, and scoring goals was even more difficult.

Not so much in Game 4, raising all sorts of questions about the rest of the deadlocked series.

Chicago's 6-5 overtime victory at Boston on Wednesday night was the highest-scoring game in this year's NHL playoffs. There were breakaways, rebounds, long slap shots and tips. Eleven goals in all, coming from all over the ice.

When it was over, the Blackhawks and Bruins were tied at two games apiece heading into Game 5 on Saturday night.

"I guess a series like this can take some unexpected turns sometimes, and you saw that last night," Blackhawks captain Jonathan Toews said Thursday. "I'm not going to make any predictions for what happens in the next game, but obviously there's a lot of things we want to carry into this game, Game 5, here."

The biggest variable could be the recovery of goalies Tuukka Rask of the Bruins and Corey Crawford of the Blackhawks, who have a couple days to find their game again before the series resumes in Chicago.

Rask and Crawford had been the best two goalies in the playoffs before each of them stumbled under heavy pressure in Game 4. Rask gave up too many prime rebound opportunities, and Crawford was beaten repeatedly on his glove side.

"Every goal is stoppable, but I don't think there was any weak one, so to speak," said Rask, who was coming off a 2-0 shutout and had allowed just eight goals in the previous eight playoff games. "Mistakes piled up and I wasn't able to bail our guys out. Sometimes you do, sometimes you don't."

Crawford was great in each of the first two finals games in Chicago. He had 51 saves in the three-overtime series opener, keeping the Blackhawks in the game long enough for Andrew Shaw to score the winning goal in a 4-3 victory.

Crawford had 33 stops when the series shifted to Boston for Game 3, but Chicago was unable to get anything going against Rask. And then came more of the glove-side problems on Wednesday night that the Bruins have exploited all series long.

"A couple tough breaks last night, especially when we had the lead at 3-1 or 4-2, Boston is going to open up a little bit," Blackhawks forward Patrick Kane said Thursday. "I think for us that we can play better defensively, maybe get in some shooting lanes and block some of those shots."

Chicago held leads of 1-0, 3-1, 4-2 and 5-4, but Boston rallied each time. The glove-side issue is a tricky little one for coach Joel Quenneville and the Blackhawks, who know that's where the Bruins are trying to go, but don't want Crawford to focus so much on that area that it gets into his head.

"We're very comfortable with Corey," Quenneville said, dismissing the idea of inserting backup Ray Emery. "Corey has been rock solid all year for us, and when he's got the ball, he's been outstanding, and he's the biggest reason why we're here today."

Rask was working on a shutout streak of 129 minutes, 14 seconds when Michal Handzus had a beautiful sliding score in the first period Wednesday night off a nice pass from Brandon Saad on a fast break.

It was a sign of things to come for the Bruins, who had sustained trouble with the Blackhawks' speed for the first time in the series.

Marcus Kruger completed a 2-on-1 break in the second period with his third goal of the playoffs. Kruger and Michael Frolik got down the ice so quickly that there was time for Kruger to poke home his own rebound after Rask stopped his first attempt.

"I thought we gave them a lot of space," Bruins coach Claude Julien said. "It doesn't mean they don't have a pace to their game, but it means we gave them too many options. And the neutral zone for me, not just on the forecheck but even our neutral zone on the counter, wasn't very good."

Zdeno Chara, Boston's 6-foot-9 defenseman, was back during the rush by Kruger and Frolik but was unable to break it up. The 2009 Norris Trophy winner was on the ice for five of Chicago's six goals, with the Blackhawks using their speed to make life difficult on the captain of the Bruins.

"I think he was OK," Julien said. "There's no doubt they went after him and he was OK, because our whole team was OK. I don't think anybody on our team can stand up today and say I thought I had a great game, and that's why we're sitting here today tied 2-all."

The move by Quenneville to put Toews and Kane back together on a line with Bryan Bickell also played a role in the rough night for Chara and Rask. Toews had a tip-in for his first goal since May 25 against Detroit, snapping a 10-game drought. Kane had a nifty rebound score for his first goal of the series.

The productive night for that line ? Bickell had two assists and was credited with six hits ? could lead to some adjustments for Boston in the pivotal Game 5.

"I think you want to learn from every game, regardless of if you win or lose," said Bruins center Chris Kelly, who failed to convert a prime scoring opportunity on Wednesday night. "Like winning, you want to put the game behind you. It's in the past, there's nothing you can do about it. Look to the next one."

China supercomputer clocks in as world's most powerful

China supercomputer: China's Tianhe-2 has bested its American counterpart in a semi-annual ranking of the world's most powerful supercomputers.

It's just that today, they're a bit faster than the?Electronic Numerical Integrator And Computer, the first general purpose digital computer. First?announced?in 1946 and in operation until 1955, ENIAC, which took up 1,800 square feet and?weighed?60,000 lbs., could perform up to 5,000 calculations per second, as long as it was addition. For division problems, it could do 38 per second.

Today's fastest computer? Almost 34,000 trillion calculations per second.

That distinction belongs to Tianhe-2, a supercomputer developed by China?s National University of Defense Technology. According to TOP500, a project that twice a year measures the world's 500 fastest supercomputers, Tianhe-2 is about twice as powerful as the second fastest, the?Titan supercomputer based at the?US Department of Energy's Oak Ridge National Laboratory.?

The TOP500 list is compiled by computer scientists at the University of Mannheim, Germany; Lawrence Berkeley National Laboratory; and the University of Tennessee, Knoxville. Researchers measure computing power in "flop/s," that is, floating point operations per second. The bog-standard 2.5 gHz processor found in an office laptop is theoretically capable of?10 billion flop/s, or 10 gigaflop/s.

TOP500 measured the Tianhe-2 at 33.86 quadrillion flops/s, or 33.86 petaflop/s. To put things in perspective, that would be the equivalent of stringing together about 3.4 million standard processors.?

Which is sort of what they did, but with faster processors. According TOP500, the Tianhe-2 is composed of 16,000 nodes, each of which has two Intel Xeon Ivy Bridge processors and three Xeon Phi processors.?

Intel chips remain a popular choice for those wanting to build supercomputers. According to TOP500, the Santa Clara, Calif. company provides the processors for more than four fifths of the 500 fastest supercomputers.

The processors may be American, but the rest is all Chinese, according to University of Tennessee computer scientist and TOP500 editor Jack Dongarra. ?Most of the features of the system were developed in China, and they are only using Intel for the main compute part. That is, the interconnect, operating system, front-end processors and software are mainly Chinese,? said Dr. Dongarra in a press release.

Tianhe-2, whose name means "Milky Way 2," marks China's return to the top position of the list since November 2010, when the machine's earlier incarnation, Tianhe-1A reigned. Tianhe-1A, which was clocked at ?2,566 billion flop/s, now ranks at number 10.

If processor technology continues to advance at the same pace that it has in the past, two decades from now we'll all be walking around with Tianhe-2's in our pockets, or perhaps embedded in our contact lenses. As TUAW noted in 2011, the iPad 2 has more processing power than the supercomputers of the 1990s.?

Afghan Taliban say they killed 4 US troops

KABUL, Afghanistan (AP) ? The Taliban claimed responsibility Wednesday for an attack in Afghanistan that killed four American troops just hours after the insurgent group announced it would hold talks with the U.S. on finding a political solution to ending the nearly 12-year war in the country.

The deadly attack underscores the challenges ahead in trying to end the violence roiling Afghanistan through peace negotiations in Qatar with militants still fighting on the ground.

Taliban spokesman Zabiullah Mujahid said the insurgents fired two rockets into the Bagram Air Base outside the Afghan capital, Kabul, late on Tuesday. American officials confirmed the base had come under attack by indirect fire ? likely a mortar or rocket ? and that four U.S. troops were killed.

The attack came as the Taliban opened a political office in the Qatari capital of Doha, and announced they were ready for peace talks. The decision was a reversal of months of failed efforts to start negotiations while Taliban militants intensified a campaign targeting urban centers and government installations across Afghanistan.

The Taliban announcement followed a milestone handover in Afghanistan earlier Tuesday as Afghan forces formally took the lead from the U.S.-led NATO coalition for security nationwide. It marked a turning point for American and NATO military forces, which will now move entirely into a supporting role. It also opened the way for the withdrawal of most foreign troops in 18 months.

President Barack Obama cautioned that the peace talks with the Taliban would be neither quick nor easy but that their opening a political office in Doha was an "important first step toward reconciliation" between the Islamic militants and the government of Afghanistan.

In setting up the office, the Taliban said they were willing to use all legal means to end what they called the occupation of Afghanistan ? but did not say they would immediately stop fighting.

American officials said the U.S. and Taliban representatives will hold bilateral meetings in the coming days. Afghan President Hamid Karzai's High Peace Council is expected to follow up with its own talks with the Taliban a few days later.

Key issues unresolved for Maine lawmakers

AUGUSTA, Maine (AP) -- Maine lawmakers began the final days of the 2013 session by pushing through a slew of bills Monday while they await Republican Gov. Paul LePage's decision on the state's budget and a proposal to expand health care coverage.

Lawmakers gave the first nod Monday to legislation to prohibit insurance companies from hiking rates based on where someone lives and as well as a bill to block the government from collecting cellphone messages or conversations without a warrant.

But while the Democratic-controlled Legislature moves through the final bills of the session, two key questions remain: whether LePage will accept or veto a $6.3 billion, two-year state budget that includes temporary tax increases and a bill expanding Medicaid to more Mainers under the federal health care overhaul.

Lawmakers sent the measures to LePage's desk Thursday night, but spokeswoman Adrienne Bennett said Monday that there is still no word on what action the governor will take. LePage has said he won't sign a budget that includes tax increases and has already vetoed a broader Medicaid expansion bill.

The governor has 10 days to look over legislation before has to act or it goes into law without his signature, which means lawmakers could go home Wednesday with those two issues still up in the air.

Democrats are urging the governor to act quickly. Assistant Majority Leader Jeff McCabe of Skowhegan said that lawmakers will return after the session is over to attempt to override the vetoes with a two-thirds vote in each chamber, if necessary.

"It's going to end up costing taxpayers more money to have to bring us back based on the governor's inaction, which is disappointing," he said.

"If he's going to veto it, he can veto it. He can have his symbolic moment instead of dragging it out."

Bennett said the governor has expressed that he plans to take the time to look over the legislation. She said he needs time to take a close look at the changes lawmakers made to the lengthy budget proposal.

But as lawmakers wait to see if they'll return to the Capitol after the session ends, they did move forward some significant legislation Monday:

? INSURANCE RATES: The House gave initial approval to a bill that reverses a provision of a law enacted last session that allows insurance companies to determine rates based on where someone lives. Supporters say insurance rates for rural residents have skyrocketed since the law went into place, which has hurt small businesses. But opponents worry that it will eliminate the incentive that hospitals and providers have to be more efficient while raising rates for people living in cities.

? CELLPHONE PRIVACY: The Senate voted unanimously in favor of a bill that prohibits a government entity from collecting cellphone messages or conversations with a warrant, unless it's an emergency or the owner has given their consent. The bill faces further votes in the House and Senate.

? CAREER AND TECHNICAL EDUCATION: The Senate gave initial approval to a bill that will create a program allowing students pursuing a career and technical education to get some of their college credits while they're still in high school. Starting in their junior year, students could earn credits that count toward both their high school diploma and a secondary education degree, which supporters say will save them both time and money.
